Abstract
Afghanistan has abundant natural resources that have not been fully and economically utilized. The existing laws on Afghanistan’s natural resources are based on Article 3 of the Constitution, which states: “No law can be against the beliefs and precepts of the holy religion of Islam.” In this study, in accordance with the subject, we used the descriptive analytical research method and concluded that the laws related to natural resources and a brief comparison of them with the precepts of Islam show that the legislator has observed Article 3 of the Constitution approved in 1382 in all laws regarding natural resources. Therefore, the findings of the study show that no legal article regarding natural resources contradicts religious teachings and the distribution of natural resources has taken place, although it has been limited; but an attempt has been made to be within the framework of the laws.
